  • The senator now wants to reintroduce the bill to also cover decentralized entities.

The past few weeks have seen some hostile moves by several regulatory authorities in the US including the recent $30 million imposed on Kraken forcing it to shut down its crypto-staking product. There has also been the issue of the US SEC accusing Paxos Trust of issuing unregistered security, the Binance USD (BUSD).

Going by these trends, Jake Chervinsky a lawyer and Chief Policy Officer at Blockchain Association tweeted saying that “fears of a crypto crackdown have never been higher.”

Sen. Warren’s AML bill

Just as if the recent developments are not enough, Senator Elizabeth Warren has promised to reintroduce the Digital Asset Anti-Money Laundering Act of 2022 that she first introduced on Dec. 15, 2022. The new bill, according to the senator, will cover decentralized entities” like decentralized organizations (DAOs) and decentralized finance (DeFi) protocols.

Previously during the February 14 Senate Banking Committee hearing titled ‘Crypto Crash: Why Financial System Safeguards are Needed for Digital Assets,’ Sen. Warren said that the crypto community decentralized entities that operate on code to be excused from AML requirements. She said:

“In other words, they want a giant loophole for DeFi written into the law so they can launder money whenever a drug lord or a terrorist pays them to do so.”

According to Sen. Warren, this is why she believed including DeFi and DAOs in the AML policies is important. She noted that the current AML laws do not cover the broader crypto market and it was probably the reason why the crypto exchange ShapeShift was restructured as a DeFi platform.

Sen. Elizabeth Warren (D-MA) is reintroducing a bill that seeks to extend the jurisdiction of the Financial Crimes Enforcement Network (FinCEN) to financial activities related to distributed ledger technology (DLT), decentralized finance (DeFi) and digital autonomous organizations (DAOs).

The Aligning Mechanisms for Preventing Money Laundering (AML) Act of 2021, introduced on March 30th, is aimed at updating financial regulations to keep up with the pace of innovation in the emerging DLT arena.

The bill expands FinCEN’s powers and financial intelligence capabilities to improve its ability to detect, investigate, and prosecute illicit activity associated with DeFi and DAOs. Sen. Warren stated that “The current financial regulatory framework is failing to keep up with the rapid development of these innovative technologies, and we must take steps to ensure our laws and regulations keep up with the pace of innovation to properly combat money laundering and other illicit activities.”

The AML Act gives FinCEN greater authority to examine and take enforcement actions against entities on DLT-based networks. It also sets deadlines for regulatory action and requires entities involved in DLT-based infrastructure and service provision.

As current laws and regulations lack clarity on the compliance obligations of DLT-based services, the new law also seeks to provide some legal certainty as it expands the definitions of financial institutions to cover services involving development, storage, or utilization of digital assets.

The AML Act also seeks to bridge the regulatory gap between digital asset service providers and financial institutions by establishing minimum knowledge requirements and strengthening due diligence and reporting requirements.

The bill is the latest attempt by Sen. Warren to ensure that these new technologies are regulated under the auspices of existing laws and regulations and that the US remains a leader in the DLT space. It should be noted that other members of Congress have introduced similar legislation in recent months. With the backing of members from both sides of the aisle, it’s likely that the AML Act of 2021 will become law in the near future.
